    1. Introduction

    These terms cover izzyis.net and IzzyIs Tools at tools.izzyis.net, including the QR Code Generator, Wheel Spinner, Word Counter for Social Media, Placeholder Text Generator, and Hushcode (on the web, as an installed app, and in the Microsoft Store). These sites and apps are run by Israel Wilkins, doing business as IzzyIs, based in Waverly, Virginia, United States. In these terms, “IzzyIs”, “we”, and “us” mean the operator, and “the tools” means all of the above.

    Microsoft is not responsible for providing support, maintenance, or warranties for the tools.

    By using the tools and clicking “Agree” when prompted, you agree to these terms. If you don’t agree, then you must not use them.

    Our Privacy Policy explains what happens to your information. It’s part of these terms.

    Age requirements

    By using the tools, you affirm that you are 18 years or older to enter into these terms, or, if you are not, that you are 13 years or older and have obtained parental or legal guardian consent to enter into these terms. Please have your parent or legal guardian read these terms with you.

    2. Using the tools

    The tools are free to use, for personal or commercial work. You don’t need an account.

    You agree not to:

    • use the tools to break the law or to harm, harass, or deceive anyone
    • try to break, overload, or get around the security of the tools or our servers, including Hushcode’s sign-in helper
    • copy the sites as a whole, or present them as your own
    • use automated scripts to send large numbers of requests to our servers

    We can stop anyone who does these things from using the tools.

    3. Your content

    What you make with the tools is yours: your notes, codes, wheels, text, and anything else. We don’t claim any rights to it.

    The tools run on your own device. What you type isn’t sent to us, so we can’t see it, store it, or recover it for you. Keeping copies of anything important is up to you. Hushcode’s Back up all notes and Export features can help with that.

    4. Hushcode and Google Drive sync

    Hushcode’s sync is optional. When you turn it on, an encrypted copy of your notes is saved in a hidden folder in your own Google Drive. Your use of Google Drive is also covered by Google’s own terms.

    Hushcode only asks Google for access to its own hidden folder, not to the rest of your Drive. Hushcode’s use of information received from Google APIs follows the Google API Services User Data Policy, including its Limited Use requirements.

    Sync uses a sync key that only your devices know. If you lose every device with the key and your sync link, nobody, including us, can unlock the synced copy.

    You can turn sync off at any time in Hushcode, and remove Hushcode’s access from your Google Account settings.

    5. Ads, analytics, and donations

    Some pages show ads and use analytics, as explained in the Privacy Policy. Hushcode doesn’t.

    Donations through Ko-fi are voluntary and don’t buy any extra features or support. Ko-fi has its own terms.

    6. Our work

    The sites, their design, the IzzyIs name, the IzzyIs Tools and Hushcode names and logos, and the mascot named “Lemon” belong to IzzyIs. Please don’t use them in a way that suggests we made or approve something we didn’t.

    The tools use open-source libraries under their own licenses. Those licenses are listed on the sites and in the files that come with them, and nothing in these terms limits your rights under them.

    7. Feedback

    If you send us an idea or a bug report, we may use it to improve the tools without owing you anything for it.

    8. Changes and availability

    We may change, pause, or stop any tool at any time, and we don’t promise any tool will always be available. Hushcode keeps working offline on your device even when our sites are down, but sync and updates need the internet.

    We may update these terms. When we do, we’ll change the date at the top and notify you with a banner at the top of the webpage and a message that stays permanently until you agree or disagree in Hushcode. Disagreeing in Hushcode will close the page.

    9. No warranty

    THE TOOLS ARE PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DON’T PROMISE THE TOOLS WILL BE ERROR-FREE, SECURE, OR THAT YOUR DATA WON’T BE LOST. FOR EXAMPLE, CLEARING YOUR BROWSER’S DATA DELETES HUSHCODE NOTES THAT AREN’T BACKED UP OR SYNCED.

    10. Limitation of liability

    TO THE FULLEST EXTENT THE LAW ALLOWS, IZZYIS WON’T BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, OR REVENUE, THAT COMES FROM USING OR NOT BEING ABLE TO USE THE TOOLS. OUR TOTAL LIABILITY FOR ANY CLAIM ABOUT THE TOOLS IS LIMITED TO THE GREATER OF WHAT YOU PAID US FOR THEM IN THE 12 MONTHS BEFORE THE CLAIM (USUALLY NOTHING, SINCE THEY’RE FREE) OR $50.

    SOME PLACES DON’T ALLOW THESE LIMITS, SO SOME OF THEM MAY NOT APPLY TO YOU.

    11. Indemnity

    If someone makes a claim against us because of how you used the tools, or because you broke these terms, you agree to cover our reasonable costs, including reasonable attorneys’ fees, from that claim.

    12. Governing law

    These terms are governed by the laws of the State of Virginia, United States, without regard to its conflict of law rules. Any dispute about them goes to the state or federal courts located in or having jurisdiction over Sussex County, Virginia.
